California’s Proposition 65 law prohibits businesses from exposing individuals to a chemical known to the State to cause cancer or reproductive toxicity without first giving clear and reasonable warning.

Proposition 65 also prohibits businesses from discharging cancer-causing or reproductively toxic chemicals into water or onto or into land where such chemical passes or probably will pass into any source of drinking water.

CASES LITIGATED UNDER PROPOSITION 65

As You Sow v. Conbraco et al. Complex litigation against 58 defendants for alleged discharge of lead from plumbing valves and other drinking water systems made of copper alloy, bronze and/or brass.

Ecological Rights Foundation Numerous suits have been brought for exposure to lead in bookcases, china cabinets, desks, doors, lamps, kitchen cabinets, and other stained glass products. This litigation has have resulted in elimination of lead caming and lead solder from products, warnings to past customers, removal of leaded products from inventory and store shelves, and monetary payments to reduce harm from toxic chemicals or increase awareness of health hazards posed by toxics.
